God vs. the Gavel challenges the pervasive assumption that all religious conduct deserves constitutional protection. While religious conduct provides many benefits to society, it is not always benign. The thesis of the book is that anyone who harms another person should be governed by the laws that govern everyone else - and truth be told, religion is capable of great harm. This may not sound like a radical proposition, but it has been under assault since the 1960s. The majority of (...) academics and many religious organizations would construct a fortress around religious conduct that would make it extremely difficult to prosecute child abuse by clergy, medical neglect of children by faith-healers, and other socially unacceptable behaviors. This book intends to change the course of the public debate over religion by bringing to the public's attention the tactics of religious entities to avoid the law and therefore harm others. (shrink)

Research ethics committees—animal ethics committees for animal-based research and institutional research boards for human subjects—have a key role in research governance, but there has been little study of the factors influencing their effectiveness. The objectives of this study were to examine how the effectiveness of a research ethics committee is influenced by committee composition and dynamics, recruitment of members, workload, participation level and member turnover. As a model, 28 members of AECs at four universities in western Canada were interviewed. Committees (...) were selected to represent variation in the number and type of protocols reviewed, and participants were selected to include different types of committee members. We found that a bias towards institutional or scientific interests may result from a preponderance of institutional and scientist members, an intimidating atmosphere for community members and other minority members, recruitment of community members who are affiliated with the institution and members joining for reasons other than to fulfil the committee mandate. Thoroughness of protocol review may be influenced by heavy workloads, type of review process and lack of full committee participation. These results, together with results from the literature on research ethics committees, suggested potential ways to improve the effectiveness of research ethics committees. (shrink)

As the expansion of the Internet and the digital formatting of all kinds of creative works move us further into the information age, intellectual property issues have become paramount. Computer programs costing thousands of research dollars are now copied in an instant. People who would recoil at the thought of stealing cars, computers, or VCRs regularly steal software or copy their favorite music from a friend's CD. Since the Web has no national boundaries, these issues are international concerns. The contributors-philosophers, (...) legal theorists, and business scholars, among others-address questions such as: Can abstract ideas be owned? How does the violation of intellectual property rights compare to the violation of physical property rights? Can computer software and other digital information be protected? And how should legal systems accommodate the ownership of intellectual property in an information age? Many large corporations now have written codes of ethics to guide the business/marketing activities of employees. The purpose of this study was to determine the frequency and types of topics which are covered in the ethics policy statements of large U.S. corporations. The results indicated that the topics covered most often (respectively) were: misuse of funds/improper accounting, conflicts of interest, political contributions, and confidential information. As part of a larger study eliciting Canadian producer and non-producer views about animal welfare, open-ended, semi-structured interviews were used to explore opinions about animal welfare of 20 Canadian pig producers, most of whom were involved in confinement-based systems. With the exception of the one organic producer, who emphasized the importance of a “natural” life, participants attached overriding importance to biological health and functioning. They saw their efforts as providing pigs with dry, thermally regulated, indoor environments where animals received abundant (...) feed, careful monitoring and where prospective disease outbreaks could be minimized and controlled. Emphasis was also placed on low-stress handling and agreeable working conditions which were believed to promote good animal care. The fact that pigs tend to respond to such conditions with steady growth reinforced the belief that good welfare was provided. Participants supported the use of sow gestation stalls, but with some reservations, and expressed concern about welfare problems that could occur if sows were grouped. Invasive procedures (castration, tail-docking, teeth clipping) were recognized as painful but were accepted because they were seen as: (1) necessary for sales or management; (2) satisfactory trade-offs to prevent worse welfare problems such as injury or infection; or (3) sufficiently short-term to be relatively unimportant. Participants were adamantly opposed to animal neglect and some welcomed actions of animal protectionists that expose poor care. Producers also welcomed natural-science-based approaches to improving animal welfare. The findings contribute to a broader effort to identify overlapping values among different stakeholder groups as a basis for formulating mutually agreeable, farm animal care and handling polices. ABSTRACTInitial acts of self-control can reduce effort and performance on subsequent tasks – a phenomenon known as ego depletion. Ego depletion is thought to undermine the capacity or willingness to engage executive control, an important determinant of success for many tasks. We examined whether ego depletion improves performance on a task that favours less executive control: insight problem solving. In two experiments, participants completed an ego-depletion manipulation or a non-depleting control condition followed by an insight problem-solving task. Participants in the (...) depleting condition demonstrated greater insight problem-solving accuracy than those in the non-depleting control condition. Priming theories of willpower did not impact these results. Although ego depletion is widely regarded as a “state of impairment”, attendant decreases in executive control may foster insightful thinking. (shrink)

Backround Education in ethics and professionalism should reflect the realities medical students encounter in the hospital and clinic. Method We performed content analyses on Case Observation and Assessments (COAs) written by third-year medical students about ethical and professional issues encountered during their internal medicine and paediatrics clinical clerkships. Results A cohort of 141 third-year medical students wrote 272 COAs. Content analyses identified 35 subcategories of ethical and professional issues within 7 major domains: decisions regarding treatment (31.4%), communication (21.4%), professional duties (...) (18.4%), justice (9.8%), student-specific issues (5.4%), quality of care (3.8%), and miscellaneous (9.8%). Conclusions Students encountered a wide variety of ethical and professional issues that can be used to guide pre-clinical and clinical education. Comparison of our findings with results from similar studies suggests that the wording of an assignment (specifying “ethical” issues, “professional” issues, or both) may influence the kinds of issues students identify in their experience-based clinical narratives. Phase 1 healthy volunteer clinical trials—which financially compensate subjects in tests of drug toxicity levels and side effects—appear to place pressure on each joint of the moral framework justifying research. In this article, we review concerns about phase 1 trials as they have been framed in the bioethics literature, including undue inducement and coercion, unjust exploitation, and worries about compromised data validity. We then revisit these concerns in light of the lived experiences of serial participants who are income-dependent on phase (...) 1 trials. We show how participant experiences shift attention from discrete exchanges, behaviors, and events in the research enterprise to the ongoing and dynamic patterns of serial participation in which individual decision-making is embedded in collective social and economic conditions and shaped by institutional policies. We argue in particular for the ethical significance of structurally diminished voluntariness, routine powerlessness in setting the terms of exchange, and incentive structures that may promote pharmaceutical interests but encourage phase 1 healthy volunteers to skirt important rules. We examine the implications of the US government’s too-big-to-fail policy as it has been applied to banks. Using alternative measures of risk, we compare the risk-taking behavior of 11 TBTF banks, identified by the Comptroller of the Currency in 1984, to a number of non-TBTF banks. We provide both theory and new empirical evidence to support our argument that the TBTF policy leads management to significantly increase risk-taking, with no corresponding increase in performance. While prior studies have considered the effects (...) of the TBTF policy on limited, but risk-related aspects of bank behavior, such as the cost of funds, our study provides direct evidence about the risk-taking behavior associated with the TBTF policy. Our study has important implications for the current political debate regarding the too-big-to-fail policy. (shrink)

This chapter discusses methodology in feminist history of philosophy and shows that women philosophers made interesting and original contributions to the debates concerning the cosmological argument. I set forth and examine the arguments of Mary Astell, Damaris Masham, Catherine Trotter Cockburn, Emilie Du Châtelet, and Mary Shepherd, and discuss their involvement with philosophical issues and debates surrounding the cosmological argument. I argue that their contributions are original, philosophically interesting, and result from participation in the ongoing debates and controversies about the (...) cosmological argument, causal principles, and necessary existence. À travers une enquête qualitative par entretiens menée auprès des sportifs de haut niveau de l’INSEP, nous nous intéressons à leur rythme de vie qui articule des temps nombreux et variés : temps sportif, temps scolaire ou universitaire, temps professionnel, temps de récupération, temps de loisir privé et social, etc. Dans ce contexte il apparaît que leur temps objectif et leur temps subjectif ne coïncident pas toujours. Nous identifions à la fois une capacité générale de ces sportifs à gérer une (...) organisation temporelle particulièrement chargée, mais aussi de profondes variations d’un profil de sportif à l’autre, d’où l’idée d’une construction sociale du temps subjectif. Après avoir présenté l’organisation objective des temps à l’INSEP, nous analysons le poids de plusieurs facteurs sportifs et extra-sportifs pour expliquer cette disjonction et comprendre quels éléments ont tendance à favoriser un meilleur vécu d’un emploi du temps objectivement chargé. Cela nous conduit à ouvrir la discussion sur la conception des différentes temporalités de la préparation des sportifs qui demeure floue, entre temps de travail et temps de loisir. Cette préparation s’inscrit elle-même dans un contexte institutionnel spécifique : la construction du rythme de vie de ces sportifs est alors la recherche d’un compromis entre temps collectif et temps individuel. This book is an examination of the metaphysical systems of Margaret Cavendish and Anne Conway, who share many superficial similarities. By providing a detailed analysis of their views on substance, monism, self-motion, individuation, and identity over time, as well as causation, perception, and freedom, it demonstrates the interesting ways in which their accounts differ. Seeing their systems in tandem highlights the originality of each philosopher. In addition to providing the details of their metaphysical views, the book also shows how they (...) put these views to use: for Cavendish in grounding her natural philosophy and for Conway in developing her theodicy. The account of Cavendish is more naturalistic than current interpretations. It argues that God plays no substantive role in Cavendish’s philosophy. The book provides an account of Cavendish’s matter and her biological holism. It shows how sensitive and rational matter are expressed differently in different natural kinds. It provides the first account of Cavendish’s views on individuation and identity over time and a detailed account of her views on causation, arguing that nature is the only principal cause. The book also provides an account of Conway’s spiritual substance, arguing that it is a unique type of substance. It discusses Conway’s two types of motions and causation. In addition, a detailed account of her view of motion as a mode of body, and how it is transferred, is provided. Based upon the Decision Field Theory (Busemeyer and Townsend 1993), we tested a model of dynamic reasoning to predict the effect of time pressure on analytical and experiential processing during decision-making. Forty-six participants were required to make investment decisions under four levels of time pressure. In each decision, participants were presented with experiential cues which were either congruent or incongruent with the analytical information. The congruent/incongruent conditions allowed us to examine how many decisions were based upon the experiential versus the (...) analytical information, and to see if this was affected by the varying degrees of time pressure. As expected, the overall accuracy was reduced with greater time pressure and accuracy was higher when the experiential and analytical cues were congruent than when they were incongruent. Of great interest was the data showing that under high time pressure participants used more experiential cues than at other time pressures. We suggest that the dynamic reasoning paradigm has some future potential for predicting the effects of experiential biases in general, and specifically under time pressure. (shrink)

Functional magnetic resonance imaging is a powerful tool used in cognitive neuroscientific research. fMRI is noninvasive, safe, and relatively accessible, making it an ideal method to draw inferences about the brain–behavior relationship. When conducting fMRI research, scientists must consider risks associated with brain imaging. In particular, the risk of potentially identifying an abnormal brain finding in an fMRI research scan poses a complex problem that researchers should be prepared to address. This book is the collaborative response of engaged scholars from diverse countries and disciplines who are disturbed by the contemporary resurgence of anti-democratic movements and regimes throughout the world. These movements have manifest in vitriolic “nationalist” polemics, state-supported violence, and exclusionary anti-immigrant policies, less than a century after the rise and fall and horrific devastations of fascism in the early 20th century.
